Notice for Written Testimony on Board of Game Proposals

Today, the Alaska Department of Fish & Game Board Support Section learned of a technical error in their administrative procedures for distributing public notice of the Board of Game meeting held last week in Anchorage.  Due to the error, legal requirements under the Administrative Procedures Act were not met and the board's regulatory actions for the November meeting are not binding. 

"The inadvertent error in public notice is regrettable," said Diana Cote, Executive Director, ADF&G Board Support Section.  "We are taking immediate action to prevent the notification error from occurring in the future."

To correct the situation, the Boards Support Section will reissue notice of the 25 regulatory proposals considered by the board.  Written testimony on the proposals will be accepted over a 30 day period.  The BOG will review all submitted testimony and reconsider the proposals during a teleconference meeting to be held December 15, 2003.  

The deadline for submitting additional written comments will be announced in the new legal notice and on the board's website.  No oral testimony will be taken at the teleconference.  Listen-only sites will be provided in Juneau, Anchorage, and Fairbanks.

The procedures to re-notice and consider written testimony on proposals will not delay implementation of any of the regulations. 

The predator control plan for Unit 19 D-East will not need to be readdressed, and will be implemented according to the schedule discussed by the board and department at last week's Anchorage meeting. The plan is already codified in regulation and is therefore not subject to the technical error in the legal notice. 

The predator control plan that was designed for portions of Unit 13 (the "Glennallen area") will need to be reconsidered by the board during there December teleconference.  If the board ratifies the plan, the implementation date of mid-January 2004 can be met.
